DISPOSITIVA ESTE TRIBUNAL SEXTO DE CONTROL DE PRIMERA INSTANCIA DEL CIRCUITO JUDICIAL DEL ESTADO MÉRIDA, ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPUBLICA DE VENEZUELA Y POR AUTORIDAD DE LA LEY, RESUELVE: PRIMERO.- Declara CON lugar la aprehensión en situación de FLAGRANCIA del imputado JORGE LUIS PEÑA MORENO, por estar llenos los extremos del Art. 248 del COPP, por cuanto se le incautó un arma blanca (machete), ocasionó lesiones físicas a la victima según el informe médico forense, e intentó sustraerle la escopeta a la victima y opuso resistencia a los Funcionarios Policiales al momento de ser aprehendido. SEGUNDO.- Se acuerda el PROCEDIMIENTO ABREVIADO, de conformidad con el Art. 372.1 y 373 del COPP, y su remisión al Tribunal de juicio. TERCERO.- Se califica los hechos ocurridos como DELITO PORTE ILICITO DE ARMA BLANCA (MACHETE), RESISTENCIA A LA AUTORIDAD, ROBO PROPIO EN GRADO DE TENTATIVA Y LESIONES PERSONALES LEVES, tipificados en los artículos 277, 218.....
