Por los motivos anteriormente señalados y en virtud de las disposiciones legales precitadas, este JUZGADO PRIMERO DE MUNICIPIO ORDINARIO Y EJECUTOR DE MEDIDAS DE LOS MUNICIPIOS ALBERTO ADRIANI, ANDRES BELLO, OBISPO RAMOS DE LORA Y CARACCIOLO PARRA OLMEDO DE LA CIRCUNSCRIPCION JUDICIAL DEL ESTADO MERIDA, ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPUBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY, declara: PRIMERO: SIN LUGAR, la cuestión previa contenida en el ordinal 8º del artículo 346 del Código de Procedimiento Civil, opuesta por el ciudadano JOSE DOMINGO AMAYA BARRETO, venezolano, mayor de edad, titular de la cédula de identidad Nº V-9.201.441, asistido por los abogados Johny Graterol Zambrano y Leidy Zaray Montoya García, titulares de las cédulas de identidad Nº V-9.028.495 y 17.793.808, inscritos en el Inpreabogado bajo los Nº 25.728 y 126.296, en su orden.
